Opting Out of AWAC.

The majority of the CCRs for each tract in Arrowhead Woods contain an Opt-Out Provision which allows record homeowners in the tract to collect signatures from the record owners of not less than 55% of the total area of the tract to modify, amend, cancel or annul any or all covenants, conditions and restrictions for that tract. This can be done at anytime. The exemplar Opt-Out provision for tract 8053 is below.

The CC & R’s – Article XIII.
“The owners of record of lots or building sites in said Tract having an aggregate area equivalent to not less than 55% of the total area of all of said property may, at any time, modify, amend, cancel or annul, with respect to all of said Tract, all or any of the covenants, conditions and restrictions contained in this Declaration and any supplement or amendment thereto, by instrument in writing signed by said owners and acknowledged by them so as to entitle it to be recorded in the Office of the County Recorder of San Bernardino County, California.”

The first step a homeowner must take is to find his or her tract number. This is done by either typing your last name, first name or APN number is the San Bernardino County ARC database using the basic search option. Type your last name, first name or APN (Assessor's Parcel Number) and click search. In the search results to the right click on your property and the map will zoom to your house. Then click on Report and then choose View Legal Descriptions. Your Arrowhead Woods Tract number will be in the description. For example, it will read ARROWHEAD WOODS TRACT NO 8053.

The second step is to search the CCRs page on our site and download your specific CCR. Once downloaded, you can check the Articles to see if the Opt-Out Provision exists for your tract. The Opt-Out provision is usually found in Article XIII. A few of the tracts will not have an Opt-Out Provision.

The third and final step is to collect signatures from record homeowners in your tract which will enable the homeowners to modify, amend, cancel or annul their CCRs. Homeowners may also name their own Architectural Committee for their specific tract other than AWAC, Inc.
